BineClaim Terms of Service

Version 1.2 · Effective date: October 6, 2026 · Last updated: October 6, 2026

These terms govern your use of the BineClaim website and application.

1. Agreement to Terms

These Terms of Service form a binding agreement between you and BineCloud LLC (“BineClaim,” “we,” “us,” or “our”), a Georgia company with its principal office at 4260 Beverly Lane NE, Atlanta, GA 30342, United States. By creating an account, accessing, or using the BineClaim website or application (together, the “Services”), you agree to these Terms. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business, and “you” refers to that business as well as the individual acting on its behalf.

If you do not agree to these Terms, you may not use the Services.

2. What BineClaim Does

BineClaim is invoice management and accounts receivable software. It helps businesses and individuals track invoices they have issued, send payment reminders to their customers, and manage the process of following up on unpaid amounts. BineClaim is not a debt collection agency, does not purchase or take assignment of debts, and does not act as your customer’s creditor. You remain solely responsible for the accuracy of the invoices and customer information you enter, and for complying with any law that applies to how you communicate with your customers about amounts owed, including any applicable state or federal debt collection or consumer protection law.

3. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use BineClaim. When you create an account, you agree to provide accurate and complete information and to keep it up to date.

Multi-Factor Authentication

Multi-Factor Authentication (MFA) is mandatory for every BineClaim account, customer and administrative alike. You must successfully complete MFA before you are granted access to the Services. You are responsible for maintaining control of your MFA device or method and for notifying us immediately at support@binecloud.com if you suspect your account or MFA method has been compromised.

You are responsible for all activity that occurs under your account, whether or not you authorized it, except to the extent it results from our failure to meet our security obligations under these Terms.

4. Purchases, Subscriptions, Fees, and Billing

BineClaim offers recurring subscriptions and a $49 One-Time Case purchase. Fees, billing frequency, included features, and any applicable trial terms are presented at purchase. Payments are processed by Stripe, and by purchasing you also agree to Stripe’s terms governing the payment method you provide.

Unless otherwise stated, subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time through your account settings, effective at the end of the current billing period. Except as required by law or expressly stated at the time of purchase, fees already paid are non-refundable.

The One-Time Case plan is a single, non-recurring payment that unlocks the features identified at checkout for one case. It does not automatically renew and therefore has no subscription to cancel. Access remains tied to the eligible case assigned to the purchase unless you upgrade or your account is suspended or terminated under these Terms.

We may change our pricing with at least 30 days’ notice before the change takes effect for existing subscribers. Full detail on cancellations, refunds, and plan changes is available in our Refund and Cancellation Policy.

5. Your Content and Data

“Your Content” means the invoice data, customer information, and any other material you upload to or create within BineClaim. You retain ownership of Your Content. By using the Services, you grant BineClaim a limited license to host, process, and transmit Your Content solely as necessary to provide the Services to you, including generating invoice reminders and, where you enable it, AI-assisted features described in our AI Usage & Responsible AI Policy.

You are responsible for having the necessary rights and legal basis to submit Your Content to BineClaim, including any personal information about your own customers. Our handling of that information on your behalf as a processor is governed separately by our Data Processing Addendum.

6. Acceptable Use

You agree not to use BineClaim to:

  • Send communications that are fraudulent, harassing, threatening, or that misrepresent amounts owed
  • Violate any applicable law, including consumer protection, debt collection, or data protection laws
  • Attempt to gain unauthorized access to any part of the Services or another user’s account
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or attempt to extract the source code of the Services, except where applicable law expressly permits it
  • Use the Services to build a competing product

We may suspend or terminate your access if we reasonably believe you have violated this section.

7. SMS and Communications Consent

If you use BineClaim to send text messages to your own customers about an invoice or balance, you are responsible for obtaining and documenting valid consent from that customer before sending, and for the lawfulness, accuracy, timing, and content of that communication under the Telephone Consumer Protection Act and any other law that applies to you. BineClaim provides the consent-recording workflow, opt-out enforcement, and audit trail described in our SMS and Communications Compliance Policy, but using these tools does not shift legal responsibility for your communications to BineClaim. Multi-Factor Authentication and other account-related messages sent to you directly are governed by the SMS terms below.

BineClaim SMS program terms

  • Program description: By providing your mobile number and checking the SMS consent box, you agree to receive one-time verification codes for Multi-Factor Authentication and account or invoice notifications from BineClaim.
  • Message frequency: Varies based on your login activity and account settings.
  • Cost: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • Opt out: Reply STOP at any time to cancel. You will receive one final confirmation message. Reply START to re-subscribe.
  • Help: Reply HELP or email support@binecloud.com for assistance.
  • Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

8. Third-Party Services and Integrations

BineClaim relies on and integrates with the following third-party providers to deliver the Services: Amazon Web Services for hosting, Anthropic for AI-assisted features, Stripe for payment processing, Twilio for SMS delivery, Resend for transactional email, and Google Analytics for usage analytics. If you choose to enable them, BineClaim also supports optional integrations with Dun & Bradstreet for commercial credit checks and with CRM providers you select. Your use of any optional integration is also subject to that third party’s own terms.

9. AI-Assisted Features

Certain features within BineClaim, such as drafting reminder messages or summarizing account activity, are powered by Anthropic’s Claude API. These features are intended to assist you, not to replace your judgment, and you remain responsible for reviewing and approving any communication sent to your customers. Further detail on how AI is used and governed is available in our AI Usage & Responsible AI Policy.

10. Intellectual Property

BineClaim, including its software, design, trademarks, and underlying technology, is owned by BineCloud LLC and its licensors. Nothing in these Terms transfers any ownership of BineClaim’s intellectual property to you. You may not use the BineClaim name, logo, or trademarks without our prior written consent.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, BineClaim disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that any invoice will actually be paid as a result of using BineClaim.

12. Limitation of Liability

To the fullest extent permitted by law, BineClaim and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Services. Our total liability for any claim arising out of these Terms or the Services will not exceed the amount you paid to BineClaim in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold BineClaim harmless from any claims, damages, or expenses, including reasonable attorneys’ fees, arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right in connection with the invoices or customer communications you manage through BineClaim.

14. Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law. Upon termination, your right to use the Services ends, though provisions of these Terms that by their nature should survive, including Sections 10 through 16, will continue to apply.

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles.

Before filing a claim against BineClaim, you agree to first contact us at support@binecloud.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in Fulton County, Georgia, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. You and BineClaim each waive the right to participate in a class action or class-wide arbitration.

If you are a consumer located in the European Economic Area or the United Kingdom, nothing in this section removes any mandatory consumer protection rights available to you under the law of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the app at least 15 days before the changes take effect. Continued use of the Services after that date constitutes acceptance of the updated Terms.
